Terms of Service

1. Who we are

LockUp (“LockUp,” “we,” “our,” or “us”) is a security-scanning service operated by Elev8 AI Solutions & Services. By creating an account or using LockUp, you agree to these Terms.

2. What LockUp does

LockUp is an automated external security scanner. It examines websites, code repositories, REST APIs, smart contracts, and Supabase databases you submit and produces a Trust Report describing the security posture it observed. LockUp may also generate AI-assisted remediation suggestions.

LockUp is not a substitute for a qualified human security audit, formal penetration test, or accredited ISO 27001 certification. Trust Reports reflect what our scanners can observe from outside your application — they cannot guarantee an absence of vulnerabilities.

3. Your account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You are responsible for keeping your account credentials secure.
• You may close your account at any time. Visit /delete-account or contact us.

4. Acceptable use

You agree that you will not:

• Submit scan targets you do not own or do not have explicit permission to scan.
• Use LockUp to attack, harass, or harm a third party.
• Attempt to extract LockUp's scanner heuristics, prompts, or internal data through reverse engineering.
• Misrepresent a LockUp Trust Report as a third-party-audited ISO 27001 certification (it isn't, and saying so could expose both you and us under consumer-protection law).
• Resell access to LockUp without a written agreement.
• Use LockUp to circumvent our rate limits or per-tier scan quotas.

5. Subscriptions and payment

• Paid subscriptions (Pro, Enterprise) are billed in advance — monthly or annually — via Stripe.
• Annual subscriptions receive the 15% discount displayed on the pricing page.
• You may cancel at any time. Cancellation stops the next renewal; we do not pro-rate refunds for partial periods.
• Free-tier scan limits and per-tier daily AI-fix limits are described on the pricing page and in the dashboard. We may adjust limits with reasonable notice.

6. Trust Reports

The LockUp Trust Report is our independent automated assessment. It is informed by ISO/IEC 27001 Annex A, NIST Cybersecurity Framework 2.0, and the OWASP Top 10. It is not a certification. You may display a LockUp Trust Score badge on a site you own and control, but you may not modify the badge or its disclaimer.

7. Our content

The LockUp service, including its software, scanner heuristics, prompts, UI design, and brand, is owned by Elev8 AI Solutions & Services. We grant you a non-exclusive, non-transferable right to use it during your subscription. Your scan results remain yours.

8. AI-generated content

LockUp uses AI models (currently Anthropic Claude) to generate remediation suggestions and Trust Report explanations. AI output is best-effort: you should review and validate any code or configuration we suggest before applying it. We are not liable for damage caused by applying an unreviewed AI suggestion.

9. Privacy

Our handling of personal data is governed by our Privacy Policy. Our security posture and subprocessor list live at /security.

10. Warranty disclaimer

LockUp is provided “as is.” We do not warrant that the service will be uninterrupted, error-free, or that it will detect every vulnerability in your application. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to LockUp is limited to the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

12. Termination

We may suspend or terminate your account if you violate these Terms, attempt to abuse the service, or use LockUp to harm a third party. Where possible, we will provide reasonable notice.

13. Changes to these Terms

We may update these Terms when our service materially changes. We will give existing customers reasonable notice — typically via email or an in-app banner — before significant changes take effect. Continued use after that notice constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Florida unless required otherwise by your local law.
